These Terms & Conditions apply to all purchases made through samuelpeacock.com.

By placing an order through this website, you agree to the terms set out below. Please read them carefully before making a purchase.

2. Artwork

All artworks listed for sale on this website are original physical artworks by Sam Peacock, unless otherwise stated.

Every effort is made to represent each artwork as accurately as possible. Please be aware that colours may vary slightly depending on screen settings, lighting and device display.

The dimensions, medium, framing details and other relevant information are provided on each artwork listing. Please check these carefully before placing an order.

If you require additional images, a video, framing information, or advice on scale and placement, please contact us before purchasing.

3. Availability

All artworks are subject to availability.

As each artwork is unique, availability may change quickly. If an artwork has sold but the website has not yet updated, we will contact you as soon as possible and issue a full refund if payment has already been taken.

Placing an order does not guarantee acceptance of that order until it has been confirmed.

4. Prices

All prices are shown in pounds sterling unless otherwise stated.

Prices may be changed at any time, but changes will not affect orders that have already been confirmed.

The price shown on the artwork listing does not always include shipping, customs duties, import taxes, local taxes or handling fees, unless clearly stated.

5. Payment

Payment is taken securely through the payment methods available at checkout. These may include debit card, credit card, Klarna, Apple Pay, Google Pay, or other payment services supported by the website payment provider.

All payments are processed by third party payment providers. We do not store your full card details.

Where Klarna or another buy now, pay later provider is used, the payment arrangement is between you and that provider. Their own terms, conditions, eligibility checks and payment schedules will apply.

Your order will not be dispatched until payment has been successfully received.

6. Shipping and delivery

We ship to the United Kingdom, the United States, Europe and the rest of the world.

Shipping costs and delivery options will either be shown at checkout or confirmed separately, depending on the size, destination and nature of the artwork.

Original artworks are packed carefully and appropriately for transit. Larger or framed works may require specialist packing or courier services.

Delivery times are estimates only and may vary depending on destination, courier service, customs processing and other factors outside our control.

Under UK distance selling rules, goods should normally be delivered within 30 days unless another delivery timeframe has been agreed with the customer. 

7. International orders, customs and import duties

For orders delivered outside the United Kingdom, you may be responsible for customs duties, import VAT, local taxes, brokerage fees, handling charges or other costs applied by the destination country.

These charges are not controlled by us and are not usually included in the artwork price or shipping cost unless clearly stated.

It is your responsibility to check any import requirements or charges before placing an order.

We are not responsible for delays caused by customs, border processing or local import procedures.

8. Returns and cancellations

If you are purchasing as a consumer online, you normally have the right to cancel your order within 14 days of receiving the artwork, without giving a reason. 

To cancel your order, you must notify us clearly in writing within 14 days of receiving the artwork.

Once you have notified us that you wish to cancel, you then have a further 14 days to return the artwork. 

The artwork must be returned in its original condition, with all packaging, certificates and accompanying materials.

Unless otherwise agreed, you are responsible for the cost of returning the artwork. We strongly recommend using an insured and trackable courier service, as you are responsible for the artwork until it is safely received back.

Refunds will be made within 14 days of receiving the returned artwork, or within 14 days of receiving evidence that you have sent it back. 

We reserve the right to make a deduction from the refund if the artwork has been handled beyond what is necessary to inspect it, or if it is returned damaged or incomplete.

9. Refunds

Refunds will be made to the original payment method used for the purchase.

Where a refund is due, we will refund the price paid for the artwork and the standard delivery cost, where applicable. If you selected a more expensive delivery option, only the standard delivery amount needs to be refunded under UK rules. 

We cannot refund customs duties, import taxes, local taxes, currency conversion fees, payment provider charges, or other fees charged by third parties.

10. Damaged artwork

If an artwork arrives damaged, please contact us as soon as possible.

Please keep all original packaging and send clear photographs of:

  1. The damaged artwork

  2. The packaging

  3. Any visible damage to the box or crate

  4. The shipping label

This helps us assess the issue and, where applicable, raise a claim with the courier or insurer.

Please do not return a damaged artwork without contacting us first.

11. Commissions and bespoke artworks

Commissioned, customised or personalised artworks may be subject to separate terms agreed in writing before work begins.

Where an artwork has been made to your specific requirements, cancellation and return rights may not apply in the same way as they do for standard online purchases.

Any deposit, payment schedule, approval process, estimated completion date and delivery arrangements will be agreed separately in writing.

12. Framing

Where an artwork is sold framed, framing details will be included in the artwork listing where possible.

Frames are included as part of the overall presentation of the artwork. Minor variations, natural marks or small imperfections in hand finished frames should not be considered faults unless they materially affect the artwork or presentation.

If an artwork is sold unframed, this will be stated on the listing.

13. Intellectual property and copyright

Purchasing an artwork does not transfer copyright or reproduction rights.

Copyright remains with Sam Peacock unless otherwise agreed in writing.

You may not reproduce, copy, license, publish, distribute, alter, create merchandise from, or use images of the artwork for commercial purposes without written permission.

You may share images of the artwork for personal, non commercial purposes, provided Sam Peacock is clearly credited as the artist.

14. Website content

All images, text, artwork, design, branding and other content on this website are protected by copyright and intellectual property law.

You may not copy, reproduce or use any website content without permission.

15. Limitation of liability

We are not responsible for losses that were not reasonably foreseeable at the time of purchase.

Nothing in these Terms & Conditions limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or breach of your statutory rights.

16. Events outside our control

We are not responsible for delays or failure to perform our obligations where this is caused by events outside our reasonable control. This may include courier delays, customs delays, strikes, extreme weather, fire, flood, illness, technical issues, supply disruption or other unforeseen circumstances.

If such an event affects your order, we will contact you as soon as reasonably possible.

17. Privacy

Your personal information will be handled in accordance with the website’s Privacy Policy.

We will only use your information to process your order, deliver your artwork, communicate with you, comply with legal obligations, and provide any other services you have requested.

18. Governing law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes will be subject to the jurisdiction of the courts of England and Wales.
